1 Agreement to Terms

By accessing or using CharacterPub's services ("Services"), you agree to be legally bound by these Terms of Service ("Terms"), our Privacy Policy, and all applicable laws and regulations. If you do not agree with these Terms, you must not use our Services. These Terms constitute a legally binding agreement between you and CharacterPub ("we," "us," or "our").

You must be at least 18 years old or have the consent of a legal guardian to use our Services. By using our Services, you represent and warrant that you meet these requirements.

2 Description of Services

CharacterPub provides artificial intelligence-powered content generation services, including but not limited to:

  • Character creation and customization
  • AI image generation for characters
  • Image variation and pose generation
  • Custom AI model training for consistent character generation
  • Recipe scene generation and visualization
  • Automated video content creation

Service Availability and Updates

Our Services are provided on an "as is" and "as available" basis. We may update, modify, or discontinue any part of our Services without prior notice. We do not guarantee that our Services will always be available, uninterrupted, timely, secure, or error-free.

AI Technology and Limitations

Our Services utilize artificial intelligence technologies that are continually evolving. You acknowledge that AI-generated content may have limitations, inconsistencies, or imperfections. We make no guarantees about the quality, accuracy, or appropriateness of AI-generated content.

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time.

3 User Responsibilities

Our Services utilize artificial intelligence technologies that are continually evolving. By using our Services, you acknowledge and agree to the following:

  • AI-generated content may contain inconsistencies, artifacts, or unintended elements
  • Model training results may vary and are not guaranteed to produce specific outcomes
  • Generated content may inadvertently resemble existing works or real persons

AI Content Responsibility

You acknowledge and agree that:

  • You are solely responsible for reviewing and moderating all AI-generated content before use
  • You must obtain necessary rights and permissions for any reference materials used in training
  • You assume all liability for any claims arising from the commercial use of generated content

AI Model Training and Usage

Regarding AI model training and usage:

  • Training data must not contain copyrighted materials without proper authorization
  • Trained models may not be used to create content that violates our content policies
  • We reserve the right to terminate access to trained models that violate these terms

Recipe and Video Generation

For recipe and video generation services:

  • Generated recipes are for entertainment purposes only and not guaranteed for accuracy or safety
  • Video generation may include watermarks or attribution as required by our licensing terms
  • We are not liable for any consequences arising from the use of generated recipes or videos

Account Security

You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other breach of security.

4 Intellectual Property Rights

Ownership of Generated Content

The ownership and usage rights of content generated through our Services are governed by the following terms:

  • Character designs and prompts created by users remain their intellectual property
  • AI-generated images, variations, and poses are subject to our fair use policy
  • Trained models remain on our platform and cannot be exported
  • Generated videos are licensed for use according to your subscription plan
  • Recipe visualizations and scene generations are subject to content guidelines
  • CharacterPub retains ownership of all AI models, algorithms, and underlying technology
  • You grant us a worldwide, non-exclusive license to use your inputs for service improvement
  • Commercial usage rights are determined by your subscription tier

Content License

By using our Services, you grant CharacterPub a worldwide, royalty-free license to use, reproduce, modify, and distribute your input content solely for the purpose of providing and improving our Services.

7 Data Usage and Privacy

Your use of our Services is also governed by our Privacy Policy. By using our Services, you consent to our collection and use of data as described in the Privacy Policy.

Data Processing

  • We process your data in accordance with applicable data protection laws
  • We implement reasonable security measures to protect your data
  • We may use anonymized data for improving our AI models
  • You retain the right to request deletion of your personal data

8 Payment Terms

Subscription fees are billed in advance on a recurring basis. You authorize us to charge your payment method for all applicable fees. If we are unable to charge your payment method, we may suspend or terminate your access to paid features.

Refunds

Refunds are handled in accordance with our Refund Policy. Generally, we do not provide refunds for partial use of our Services or for unused subscription periods.

9 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CHARACTERPUB BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Quality or consistency of AI-generated content
  • Availability or performance of model training services
  • Accuracy or appropriateness of recipe visualizations
  • Content generated by trained models
  • Video rendering quality or completion time
  • Data loss or service interruptions
  • Any damages arising from the use of our services

Limitation of Damages

If, notwithstanding the other provisions of these Terms, CharacterPub is found to be liable to you for any damage or loss, our liability shall be limited to the amount paid by you for the Services in the 12 months preceding the incident.

10 Dispute Resolution

Any dispute arising from these Terms shall be resolved through binding arbitration conducted by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall be conducted in [Your Jurisdiction]. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction.

11 Indemnification

You agree to indemnify, defend, and hold harmless CharacterPub and its officers, directors, employees, agents, and affiliates from and against any claims, disputes, demands, liabilities, damages, losses, and costs and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.

12 Changes to Terms

We reserve the right to modify these Terms at any time at our sole discretion. If we make material changes to these Terms, we will provide notice through our Services or by other means. Your continued use of the Services after the changes take effect constitutes your acceptance of the modified Terms.

13 Prohibited Uses

You may not use our services to:

  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Generate harmful, explicit, or malicious content
  • Create deepfakes or impersonate real individuals
  • Train models using copyrighted or unauthorized content
  • Generate content that promotes hate speech or discrimination
  • Attempt to extract or reverse engineer our AI models
  • Resell or redistribute generated content outside of permitted uses
  • Automate or bulk generate content beyond plan limits

14 Usage Limits and Fair Use

Our services are subject to fair use limits based on your subscription plan:

  • Character generation and image creation have daily and monthly limits
  • Model training is restricted to approved use cases and plan limits
  • Video generation length and quality varies by subscription tier
  • Recipe scene generation has per-recipe and monthly scene limits
  • API access and batch processing are subject to rate limiting
